Philippe Goossens and Judith Fleuret commented the decision of the Second Civil Chamber of the Cassation Court.

This judgment confirms the decision of the Constitutional Council of 18 June 2010 regarding the extended compensation for damages suffered by the victim of an accident at work when the gross negligence of the employer has been recognized. This compensation does not apply to disputes that have not been finally judged as of the date of publication of this decision.
