Pourquoi les entreprises n\u2019utilisent-elles pas davantage la m\u00e9diation pour r\u00e9soudre les conflits qui peuvent les opposer\u00a0? C\u2019est \u00e0 cette question que s\u2019efforce de r\u00e9pondre le rapport r\u00e9alis\u00e9 par le Club des Juristes<\/a><\/strong> et le CMAP<\/a><\/strong>, qui sera pr\u00e9sent\u00e9 le 13 mars prochain.<\/p>\n

La m\u00e9diation est un processus amiable, volontaire et confidentiel de r\u00e9solution des \u00a0diff\u00e9rends. Les parties qui s\u2019opposent confient \u00e0 un tiers ind\u00e9pendant et impartial, form\u00e9 \u00e0 la m\u00e9diation, le soin de parvenir \u00e0 une solution \u00a0construite et accept\u00e9e par les parties.<\/p>\n

En th\u00e9orie, elle constitue pour les entreprises une voie efficace et rapide de r\u00e9solution des conflits. Recourir \u00e0 un m\u00e9diateur peut notamment permettre de pallier la lenteur des proc\u00e9dures judiciaires \u00a0et de faire \u00e9merger des solutions maitris\u00e9es.<\/p>\n

Pourtant, dans la pratique, la m\u00e9diation est encore peu utilis\u00e9e pour traiter les conflits entre entreprises. Il y entre probablement des consid\u00e9rations culturelles qui font que, souvent, les entreprises pr\u00e9f\u00e8rent l\u2019affrontement au compromis. Mais pour l\u2019essentiel, le faible recours \u00e0 la m\u00e9diation provient d\u2019une certaine m\u00e9connaissance du processus.<\/p>\n

Juristes et Avocats ont naturellement un r\u00f4le essentiel \u00e0 jouer dans le d\u00e9veloppement de ce mode alternatif de r\u00e9solution des diff\u00e9rends qui ouvre le champs des solutions pour leur client..<\/p>\n

Le rapport du Club des Juristes et du CMAP analyse en d\u00e9tail les m\u00e9rites de la m\u00e9diation et ouvre la voie \u00e0 sa plus grande utilisation par les entreprises.<\/p>\n
