You may click one of the links to switch the site language to another available language.<\/p><p><\/p>\n<p style=\"text-align: justify;\"><em><strong><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-6740 size-medium\" src=\"https:\/\/backup.altanalaw.com\/wp-content\/uploads\/2019\/02\/GOO-C-300x148.jpg\" alt=\"\" width=\"300\" height=\"148\" srcset=\"https:\/\/backup.altanalaw.com\/wp-content\/uploads\/2019\/02\/GOO-C-300x148.jpg 300w, https:\/\/backup.altanalaw.com\/wp-content\/uploads\/2019\/02\/GOO-C.jpg 522w\" sizes=\"(max-width: 300px) 100vw, 300px\" \/><\/strong><\/em><\/p>\n<p style=\"text-align: justify;\"><em><strong>Par<\/strong>\u00a0<strong><span style=\"color: #006eaa;\">Philippe Goossens<\/span>\u00a0et\u00a0<span style=\"color: #006eaa;\">David Charles<\/span><\/strong><\/em><\/p>\n<p style=\"text-align: justify;\">Le Gouvernement a pr\u00e9sent\u00e9 le 20 f\u00e9vrier 2019 en Conseil des ministres une ordonnance\u00a0<em><a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a> <\/em>portant transposition de la directive europ\u00e9enne 2018\/957 du 28 juin 2018 relative au d\u00e9tachement de travailleurs effectu\u00e9 dans le cadre d\u2019une prestation de services, dont les m\u00e9canismes juridiques et pratiques sont complexes.<\/p>\n<p style=\"text-align: justify;\">La modification des r\u00e8gles relatives au d\u00e9tachement de travailleurs r\u00e9pond \u00e0 la n\u00e9cessit\u00e9 \u00ab\u00a0<em>d\u2019accorder une plus grande protection aux travailleurs afin de pr\u00e9server la libre prestation de services sur une base \u00e9quitable\u00a0<a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a><\/em>\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">Pour parvenir \u00e0 cet objectif, la directive modifie trois aspects de la l\u00e9gislation actuelle dont l\u2019ordonnance n\u00b0 2019-116 du 20 f\u00e9vrier 2019 assure la transposition.<\/p>\n<p style=\"text-align: justify;\">Le premier, fond\u00e9 sur le principe de l\u2019\u00e9galit\u00e9 de traitement, vise \u00e0 renforcer les droits minimums garantis aux travailleurs d\u00e9tach\u00e9s dans l\u2019Etat membre d\u2019accueil au sein duquel il doit ex\u00e9cuter sa prestation de services (r\u00e8gles dites du \u00ab\u00a0noyau dur\u00a0\u00bb).<\/p>\n<p style=\"text-align: justify;\">A cet \u00e9gard, la mesure la plus embl\u00e9matique r\u00e9side dans l\u2019introduction d\u2019une d\u00e9finition unique de la r\u00e9mun\u00e9ration permettant d\u2019assurer l\u2019effectivit\u00e9 du principe selon lequel \u00ab\u00a0<em>le salari\u00e9 d\u00e9tach\u00e9 doit b\u00e9n\u00e9ficier d\u2019une r\u00e9mun\u00e9ration \u00e9gale \u00e0 celle que percevrait un salari\u00e9 local sur un poste \u00e9quivalent <a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/em>\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">Deuxi\u00e8me aspect appr\u00e9hend\u00e9 par le l\u00e9gislateur europ\u00e9en, les obligations d\u2019information en mati\u00e8re de d\u00e9tachement de salari\u00e9s int\u00e9rimaires, lesquelles font l\u2019objet d\u2019un renforcement et surtout d\u2019une simplification qui permettront \u00ab\u00a0<em>de clarifier pour chaque entreprise (employeur et utilisatrice) la nature des obligations qui leur incombent\u00a0<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/em>\u00a0\u00bb.<\/p>\n<p style=\"text-align: justify;\">Enfin, afin d\u2019assurer l\u2019effectivit\u00e9 de ces nouvelles mesures, de nouvelles sanctions administratives ont \u00e9t\u00e9 cr\u00e9\u00e9es.
